GOOD DOCUMENTATION PRACTICES IN THE FIELD

Business today is fraught with disputes, and construction work is no exception. Disputes with owners, insurance companies, architects, vendors, and other contractors abound. A common solution for positive resolutions or avoiding legal challenges is good project documentation. How do you build a well documented project from day 1?

This seminar will provide:
Tools to properly document meetings, conversations, daily reports, diaries and other day to day communication
Guidelines and sample correspondence to meet the heightened notice requirements and procedures in light of the recent Washington State Supreme Court Case Mike M. Johnson

In the event a conflict arises, these tools will ensure that the contractor is well equipped to present its side of the story. This seminar will provide contractors with the documentation practices which will increase a contractor's chances of prevailing in disputes without the need for costly legal proceedings. (2 Hours)

HOW TO WIN THE FIGHT: CHANGE ORDERS AND CLAIMS
This seminar will teach you how to prevent claims, while at the same time developing the procedures and documentation required to properly identify, document, prepare, calculate, present, evaluated, negotiate, and win valid change orders and claims. Also, learn how to win conflicts between specifications and drawings every time. These techniques apply both to public works projects and private commercial projects, and provide valuable insight to increase the profits and protect your bottom line. (8 Hours)

KILLER CONTRACT CLAUSES
The days of form contracts in the construction industry are over. Even common agreements like the AIA 201 and 401 forms are seldom offered without substantial revision and loaded special provisions. This seminar offers an organized and systematic approach to reviewing construction contracts and subcontracts. The student will leave with a contract review checklist and enough familiarity with common one-sided provisions to allow negotiation of neutral language. (4 Hours)

LIENS/CONTRACTS CRASH COURSE
If you are looking for an overview on both Construction Lien Laws and Construction Contracts, this presentation by the Linville Law Firm PLLC is exactly what you need. The Crash Course gives a great summary of how these areas of the law affect your business.

The Construction Lien Laws portion of the seminar teaches you the what, who, where, why, and when of construction liens. A lien and preliminary notice is filled out for hands-on practice, and a variety of different scenarios are presented and worked through step-by-step regarding when a lien would be most appropriate and whether a preliminary notice is required.

The Construction Contracts portion of the seminar teaches you how to prepare a contract that fits your business and how to properly respond to contracts and subcontracts which other businesses propose to you. Contracts are enforced by our courts. The beds we make are those that we'll be sleeping in. Washington law provides numerous rights and responsibilities for those persons involved in the construction business. In this seminar, we cover dispute resolution procedures, lien notices, correction of work clauses, warranties, insurance clauses, change orders, commencement/completion dates, punch lists, final payment terms, code compliance, delays, failures in communication and other sources of conflict that can and should be addressed up front in the construction contract. (4 Hours)

LIEN LAW UPDATE SEMINAR
Whether you are a General Contractor, a Subcontractor, Supplier, Architect, or Engineer, it is important to understand your lien and bond claim rights and obligations. This program is revised annually to ensure that you do. Each participant will receive a copy of the updated Lien Law Manual. (4 Hours)

RISK MANAGEMENT IN GREEN BUILDING
Managing your risk in the construction industry takes a lot of work at the front end of a project and prior to putting your first shovel in the ground. From a legal perspective, a written contract is the best way to protect you and your business from obstacles you may encounter down the road. As the construction industry is shifting to utilize "green" practices, accurately describing the work to be performed, payment schedule, expectations of the customer/contractor, disclaiming unknown issues, creating a warranty and identifying any "green" aspects to the project are critical sections to consider when drafting these documents. In addition, understanding the current laws as well as requirements of LEED is critical to protecting your business. While all of these topics cannot be covered in two hours, a brief overview will give the attendees a better idea on what to look for in managing risk at the front end of a project. (2 Hours)

WASHINGTON STATE CASE LAW AND LEGISLATIVE UPDATE
This workshop will discuss a wide variety of hot topics in the Construction Industry. Attendees leave with a broader understanding of the issues that affect your company's bottom line. (2 Hours)
